Both Social Security Disability Insurance (SSDI) and Supplementary Security Income benefits (SSI) are federal programs under the Social Security Administration, so all of their regulations are determined by federal law.  The basic requirement for both programs is that the person has a medical inability to perform any gainful activity for a sustained period of time.

Social Security Disability is divided into two programs: Social Security Disability Insurance and Supplementary Security Income. Both require that the person has the inability to perform a gainful activity for a sustained period of time.

Social Security Disability Insurance is available for people who have worked and paid FICA taxes for ten years, and for five of the ten years before they became totally disabled.

Supplementary Security Income is for completely disabled people who are indigent. This is based on household assets and income, and basically means that for a family there is no money coming in other than child support or Temporary Assistance for Needy Families.  For a single person, it means that there are less than $3000 in assets not including the house and one car.  If another person is paying rent, the SSI benefits are less.

Social Security Disability Eligibility

A person is eligible if they have medical problems that prevent the person from working.  They must provide medical documentation that proves they will be unable to work for 12 months, or that the medical problem will result in death.

Filing a Claim

SSDI claims can be filed online at www.ssa.gov.  SSI claims or a claim for both SSI and SSDI must be filed at your local social security office, or you can call SSA at 1-800-772-1213.

If your claim is denied, it’s probably because the medical records you have are not sufficient enough to prove that you are totally disabled.  Whether you aren’t seeing the right specialist, your doctor doesn’t understand the legal requirements, the documents aren’t proof enough or the administration misinterpreted the records you sent in, you need to show that you are completely disabled.  At Mevorah Law Offices, our attorneys will work with you and your doctor to make your medical records as strong as possible.
If you are denied Social Security Disability, you have 60 days from the date of the denial letter to start the four step appeal process.  The steps are;

1. Reconsideration
2. Hearing by an Administrative Law Judge
3. Repeal by the Appeals Council
4. Federal Court Complaint

If you’re denied social security disability or have questions, Mevorah Law Offices has experience with all aspects of the social security system and can help you through the appeals process to get you your social security disability benefits.

Statistics have shown that having a Social Security Disability lawyer greatly increases the chances that the SSA will accept your claim.  Call us today at 630-932-9100 for a free, no-obligation consultation.

If you’re worried about paying for an attorney, don’t! For SSI and SSDI cases, attorney’s fees are regulated by federal regulations.  Our lawyers get paid when you get paid, and if you get nothing, we get nothing. Mevorah Law Offices attorneys are paid on a contingency basis, which means no hourly fees and our percentage must be approved by the SSA.
