Lombard Assault and Battery Attorney

Criminal Attorneys Defending Clients Facing Assault and Battery Charges in DuPage County and Surrounding Cities

While assault and battery considered to be one crime in some states, under Illinois law, assaults and batteries are separate offenses. Assault is the threat of harming another physically without actually incurring bodily harm. A person who has reasonable fear of injury based on threat of violence may file assault charges. Battery is an actual physical attack on another person, which can range from making insulting physical contact to inflicting bodily injury. There are varying degrees of severity for assault and battery charges depending on factors such as whether use of a deadly weapon was involved and the seriousness of the injury that was allegedly inflicted. Some assault and battery charges are classified as misdemeanors, while others are felonies.

At Mevorah & Giglio Law Offices, our criminal defense lawyers regularly represent clients in many different types of assault and battery charges, including those of the following nature:

  • Aggravated assault with a deadly weapon - If a person was carrying or brandishing a firearm or other weapon when they allegedly committed assault, they may be charged with a Class A misdemeanor. If they discharged a firearm, Class 4 felony charges may apply.
  • Aggravated battery with a deadly weapon - While aggravated battery is usually charged as a Class 3 felony, discharging a firearm and injuring someone while committing battery may cause charges to be increased to a Class X felony.
  • Gang-related assault or battery - Charges of aggravated intimidation, a Class 1 felony, may apply if a person threatens to injure someone else while being involved in the activities of an organized street gang.
  • Assault or battery involving a police officer - Charges of aggravated assault or aggravated battery may apply if the alleged victim was a police officer who was on duty or who was targeted in retaliation for performing their official duties. In these cases, aggravated assault may be charged as a Class 4 felony, and aggravated battery that results in great bodily harm to a police officer ma;y be charged as a Class 1 felony.
  • Sexual assault - Forcing someone to engage in sexual penetration against their will due to the use of physical force or threats is a Class 1 felony.
  • Domestic battery - Causing physical harm to or making provocative contact with a family member or another member of a person's household may result in Class A misdemeanor charges, and more serious charges may apply if a person has prior convictions or used a deadly weapon.
  • Aggravated battery of a child - Causing bodily harm to a child under the age of 13 may result in Class 3 felony charges, and a charge may be elevated to a Class X felony if a child under the age of 13 suffered great bodily harm or permanent disability.
