Illinois Drunk Driving Laws

When an adult is driving with a blood alcohol content (BAC) level of .08 or higher, he or she is considered legally intoxicated. If this person is involved in an accident while driving drunk, they can be found negligent by default, regardless of the circumstances of the incident. Even if a driver has a BAC below .08, they may still be found negligent if it can be shown that their BAC level impaired their ability to drive in a safe manner. The use of marijuana, which has been legalized in Illinois for both recreational and medical purposes, may also lead to impairment, and intoxication can occur due to the combination of multiple substances, including alcohol, marijuana, illegal drugs, or prescription and over-the-counter medications.

Illinois has a zero tolerance policy for drivers under age 21 who have any trace of alcohol in their system. This means if a driver under age 21 is involved in an accident, he/she can be found negligent by default if any alcohol was consumed before getting behind the wheel. If a parent or guardian knowingly permits an underage person in their care to operate a motor vehicle after consuming alcohol, he/she may also be held responsible if an accident occurs.

Under the Illinois Liquor Control Act (also known as the Dram Shop Act), persons injured in accidents involving drunk drivers may also bring claims against a licensed commercial establishment (such as a bar or restaurant) that provided alcohol to a driver who went on to drive while under the influence and cause injuries to others. If it can be shown that the establishment sold or provided alcohol that contributed to the intoxication of the defendant, and this intoxication was the proximate cause of the accident/injuries, the establishment could be held responsible for a victim's injuries and damages.
