Both Social Security Disability Insurance (SSDI) and Supplementary Security Income (SSI) benefits are federal programs under the Social Security Administration, so all of their regulations are determined by federal law. The basic requirement for both programs is that the person has a medical inability to perform substantial gainful activity for a sustained period of time. Social Security Disability Insurance is available for people who have worked and paid FICA taxes for 10 years and for five of the 10 years before they became totally disabled. Supplementary Security Income is for completely disabled people who are indigent. Indigence is determined based on household assets and income, and it basically means that a family has no money coming in other than child support or Temporary Assistance for Needy Families. For a single person to qualify for SSI, they must own less than $3,000 in assets, not including their house and one car. If another person is paying rent, the SSI benefits may be redueced.

Social Security Disability Eligibility

A person is eligible if they have medical problems that prevent them from working. They must provide medical documentation that proves they have been or will be unable to work for 12 months, or that their medical problem will result in death.

Filing a Claim

SSD claims can be filed online at www.ssa.gov. SSI claims or a claim for both SSI and SSDI must be filed at your local social security office, or you can call SSA at 1-800-772-1213.

If your claim is denied, it is probably because the medical records you have provided are not sufficient to prove that you are totally disabled. Whether you are not seeing the right specialist, your doctor does not understand the legal requirements for disability, the documents you have provided are not proof of total disability, or the administration misinterpreted the records you sent in, you will need to take action to appeal the denial of your claim and show that you are completely disabled. At Mevorah & Giglio Law Offices, our attorneys will work with you and your doctor to make your medical records as strong as possible. If you are denied Social Security Disability, you have 60 days from the date of the denial letter to start the four step appeal process. The steps in the appeals process are:

  1. Reconsideration;
  2. Hearing by an Administrative Law Judge;
  3. Repeal by the Appeals Council; and
  4. Federal Court Complaint.

If you are worried about paying for an attorney, do not. For SSI and SSDI cases, attorney's fees are regulated by the federal government. Our lawyers get paid when you get paid, and if you get nothing, we get nothing. Our attorneys are paid on a contingency basis, which means no hourly fees will be charged, and our percentage must be approved by the SSA.
