Drug Manufacturing in Illinois

An individual can be charged for drug manufacturing under state or federal law if he/she participates in the cultivation or manufacture of a controlled substance. Cultivation is not the same as manufacturing, but the two are closely related. Cultivation typically involves the growth and harvesting of drug-producing plants. While marijuana has been legalized in Illinois, people are generally prohibited from growing or cultivating cannabis plants unless they have a license to do so. Drug manufacturing usually involves harder substances such as cocaine, LSD, and methamphetamines, which are often created in a laboratory and/or through chemical processes. Penalties for drug manufacturing or intent to sell depend on the type of substance, the location where an offense allegedly occurred (such as near a school), the size of the operation, and other circumstances in the case. Manufacture of a controlled substance (other than marijuana) is at a minimum at Class 3 felony, with prison terms starting at two to five years and fines starting at $25,000. However, for "hard drugs" such as heroin, fentanyl, or cocaine, manufacturing at least one gram can lead to Class 1 felony charges, with prison sentences of up to 15 years and fines up to $250,000.
