Afraid of Losing Your Health Insurance During Divorce? You May Have Other Options

Posted on July 28, 2017 in Family Law

DuPage County divorce lawyersExperts in divorce and money are saying that many couples are delaying divorce because they fear they will lose their insurance. Issues in Washington D.C. are only further compounding their concerns. Are you experiencing the same problem? You may have other options. Learn more about these options, including how to determine which one may be most appropriate for your situation, and how an attorney may be able to assist, with help from the following information on obtaining health insurance after a divorce.

COBRA Through a Spouse’s Employer

Those that currently have health insurance through their spouse’s employer may be eligible for COBRA insurance coverage for up to three years. The one issue to watch is if the Better Care Reconciliation Act; it could mean that those with pre-existing conditions will have a harder time finding insurance once COBRA runs out. Still, even if this does happen, divorcing parties may have other options by the time their COBRA coverage ends.

The Insurance Marketplace

Although Washington officials are currently working to repeal the Affordable Care Act, the insurance marketplace is still active and can still be used. To avoid issues with pre-existing conditions that may arise if the Better Care Reconciliation Act is passed, parties could seek insurance now, rather than waiting for the divorce to be finalized.

Medicare or Medicaid

Individuals who are considered low income or have surpassed retirement age may be eligible for coverage under Medicare or Medicaid. This coverage is free to the individual, and it does not bar people with pre-existing conditions. Keep in mind that it can take some time to get approved, and it may not cover all the services that you may have under your current insurance, but it may be better than going without coverage after the divorce.

Purchasing Private Insurance Now

Another option that divorcees with pre-existing conditions may have is to seek private insurance now before any changes are made to the health care system. Doing so could ensure coverage, even if rates go up or things change when it comes to pre-existing conditions. Just know that the insurance through a private provider may be more costly than other providers.
