In fact, some couples still value their bond and prefer to end things peacefully. Others recognize that fighting increases the financial and emotional costs for everyone involved. In these situations, parties may opt to pursue alternative dispute resolution over a litigated divorce. However, this path may not be right for every couple, and litigation may be the only way to successfully finalize a divorce.

Mediation or Litigation?

If you are considering using mediation during your divorce, it is important to know that victims of any form of abuse (mental, physical, or financial) are generally encouraged to lean towards litigation instead, as it tends to offer greater protection throughout the divorce process. Litigation is also preferred when there is suspicion of hidden assets. However, contention or disputes between the parties do not mean that a couple cannot pursue alternative dispute resolution; if anything, this particular divorce path may offer some benefits for couples, as long as both parties are at willing to bring their concerns and disagreements to the table in a civil manner. Both parties are encouraged to work together and reach a compromise on sensitive matters, like the division of assets and the creation of a parenting plan. The goal is to make sure that each party walks away with at least some of what they want and a fair portion of what they deserve.

Accordingly, it was not uncommon for women to be wed soon after they were capable of bearing children, often in their early teens. In modern society, this has changed drastically. The goals of marriage have been updated to such things as starting a family and building a life with a treasured partner. The average age of first marriage has also changed significantly.

 According to the US Census, the median age of women marrying for the first time was 26.1 years old as of 2010. This is in stark contrast to the perceived conservative era of the 1950s, when the median age was 20.3. With women increasingly being educated and working high paying jobs, there is opportunity for women to survive without relying upon a husband to earn a paycheck.

Entertainment Television’s hit reality show Keeping Up with the Kardashians. The couple married in September 2009, but controversy has wracked the relationship from the beginning. Amid accusations of infidelity on Odom ‘s part, as well as alleged cocaine and Oxycontin abuse, the couple filed for divorce last December. Kris Jenner, Kardashian’s mother, told the Huffington Post that the couple's’ troubles, Khloe’s trial in dealing with the relationship’s end, and the couple putting their $5 million mansion up for sale will all be covered in Keeping Up with the Kardashians’ upcoming ninth season.

Divorce is never easy, even when it seems that it is the right thing to do. But when large amounts of money are involved, emotions tend to cloud the judgment. It is easy to lose oneself in the mentality of “winning” versus “losing.” One may become reluctant to agree to anything out of sheer spite. A good way to avoid this kind of counterproductive thinking is to enter into a prenuptial agreement before getting married. If the time for that has come and gone, it is important to properly evaluate the worth of your assets before entering into divorce proceedings.

divorce decree IMAGEThe Chicago Tribune is reporting that a staggering 94 percent of married couples claim to be “happy” or “very happy” in their marriages, according to a poll commissioned by Thomson Reuters. The poll questioned over 1700 married or cohabiting American adults. While on the surface this poll belies the 45 percent divorce rate in America, experts are quick to advise that these results be taken with a grain of salt.

“Direct observation and analysis of the interactions is the way to really learn what’s going on in a relationship,” said certified couples’ therapist Donald Cole of the Gottman Institute. Cole did say of the poll that the statistics gleaned are “a good starting point.”
